It is probably too early to say whether the confinement and the health crisis that we experienced in 2020 will have a favorable impact on the number of births or whether, on the contrary, it will have convinced some employees, confined and working from home with their young children, to give up their project. The fact remains that during this period, the legislator on the one hand and the courts on the other have supplemented and clarified the standards in force relating to the protection of employees on the occasion of the birth of their children. In 2021, employers will therefore have to deal with new obligations and take into account the clarifications made by the courts regarding this protection.
